The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 25(1-AA)B/26/35 of the Arms Act.

The prosecution case is that on receiving information about preparation of illegal arms in the orchard of co-accused Bhushan Paswan, the police reached there and on arrival of the police four accused persons managed to escape from the scene. Though, the police chased the miscreants but they could not be apprehended. From the orchard of co-accused Bhushan Paswan several instruments of preparing illegal firearms and parts of firearm were recovered. The villagers, Dafadar and Chowkidars disclosed the name of four persons,

Patna High Court Cr.Misc. No.46353 of 2016 (2) dt.22-10-2016 2/2 who managed to escape from the scene as Bhushan Paswan, petitioner Pappu Paswan, Dhananjai Bind and Bidi Bind. It is submitted by learned counsel for the petitioner that admittedly there is no recovery from the petitioner and only on suspicion the accusation has been levelled. Similarly situated co-accused Dhananjai Bind has been granted anticipatory bail by a co-ordinate Bench of this Court vide Cr. Misc. No. 43623 of 2016. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.

10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Karaiparsurai P.S. Case No. 53 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
