JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-05-2018 By way of present application the petitioner seeks to modify the order dated 19.04.2018 passed in Cr. Misc. No. 23265 of 2018, by which the prayer for anticipatory bail of the petitioners were disposed of.
It has been submitted by learned counsel for the petitioner that in para - 4 of the said order it has wrongly been mentioned that on notice by the police, they have not appeared before the police, whereas it should be that on notice of the police they appeared and have been released on executing bond of Rs. 10,000/- and further it has inadvertently been recorded in the order dated 19.04.2018 the charge-sheet has been submitted and allegation of outraging the modesty has not been found true, where as it should have been that charge-sheet has been submitted and allegation of outraging the modesty has been found true. Similarly in para - 6 of last line it has also inadvertently been recorded that
Patna High Court Cr.Misc. No.30032 of 2018 (2) dt.16-05-2018 2/2 they were earlier on police bail.
Considering the submission of learned counsel for the petitioner as well as the averments made in the modification petition, para -4 of the order dated 19.04.2018 is substituted and be read as follows:- Submission of learned counsel for the petitioner is that on notice by the police, they have appeared before the police and they have been released on executing the bond of Rs. 10,000/- and further the charge sheet has been submitted and allegation of outraging the modesty of the informant has been found true. Similarly, para -6 of the last line, in which it has been mentioned that earlier petitioners were on police bail is treated to be deleted and as prayed for further two weeks time is allowed to the petitioners to surrender before the court below. Accordingly, this modification application is allowed.
Let a copy of this order be communicated to the court below forthwith.
