The petitioner apprehends his arrest in connection with Karpi P. S. Case No. 62 of 2017 instituted under Sections 341, 323, 307, 504/34 of the Indian Penal Code and Sections 3 and 4 of the Prevention of Witch (Daain) Practices Act, 1999. Allegation in brief is that on the accusation of practicing witch craft by the informant causing death to the son of the accused petitioner, he is said to have assaulted with lathi to the informant and her son causing injury to them. Learned counsel for the petitioner submits that there is general and omnibus allegation against all the family members of the petitioner regarding assault and no specific allegation levelled against anyone and injury found on the person of the

Patna High Court Cr.Misc. No.53107 of 2017 (2) dt.10-11-2017 2/2 informant is simple in nature except a fracture on her left hand which is not on the vital part of the body and the petitioner has got no criminal antecedent.

Having considered the aforesaid facts and circumstances, let the petitioner, namely, Basant Mester, in the event of arrest or surrender before the court below within four weeks from today, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M-IV, Arwal, DistrictArwal in connection with Karpi P.S.Case No. 62 of 2017; subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
