The petitioner is apprehending his arrest in connection with Sursand P.S.Case No.303 of 2018 , registered for offences punishable under Sections 366/34 of the Indian Penal Code. FIR disclose that the co-accused persons kidnapped the minor daughter of the informant and when the informant went to make complaints to the house of the petitioner, he was abused by the petitioner.

Submission of the learned counsel for the petitioner is that the main allegation of kidnapping is against the other accused persons and some of them have been granted privilege of anticipatory bail by a Co-ordinate Bench of this Court vide order dated 11.4.2019 passed in Cr. Misc. No.22901 of 2019

Patna High Court CR. MISC. No.25899 of 2019(2) dt.03-07-2019 2/2 and the case of the petitioner on better footing than that of the co-accused persons.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Pupri at Sitamarhi in connection with Sursand P.S.Case No.303 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is allowed.
