The petitioner apprehends his arrest in connection with Gaunaha P.S. Case No. 91 of 2016 registered under Sections 341, 307, 120B and 302 of the I.P.C. pending in the Court of S.D.J.M., Bettiah, West Champaran.

The allegation is of killing the informant by pouring kerosene oil.

Submission is that petitioner has falsely been implicated in this case. The deceased herself committed suicide by sprinkling the kerosene oil.

Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner with submission that

Patna High Court Cr.Misc. No.55480 of 2016 (3) dt.09-02-2017 2/2 petitioner is named in the F.I.R. and there is direct allegation of pouring the kerosene oil against the petitioner. Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, this application is rejected.
