The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 420 of the Indian Penal Code and Sections 30(a), 32(ii), 36, 41(i) of the Bihar Prohibition & Excise Act. There is recovery of 4383.36 litres Indian made foreign liquor from a truck and 2134.080 litres of Indian made Foreign Liquor from a pick-up-van. The petitioner is owner of the alleged seized pick-up-van.

It is submitted by learned counsel for the petitioner that petitioner was not apprehended from the

Patna High Court CR. MISC. No.29207 of 2022(2) dt.11-11-2022 2/2 spot. Nothing has been recovered from the conscious possession of the petitioner.

Considering the fact that petitioner is owner of the seized pick-up-van from which huge quantity of Indian made Foreign Liquor was recovered, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

The prayer for grant of anticipatory bail to the petitioner stands rejected.
