====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-01-2021 At the outset, learned counsel for the petitioners seeks permission to withdraw the anticipatory bail petition of petitioner no.1.
Anticipatory bail petition of petitioner no.1 is dismissed as withdrawn.
Heard learned counsel for the petitioner no.2 as well as learned Additional Public Prosecutor for the State. Petitioner apprehends arrest in a case registered for the offence punishable under Section 307 and other allied sections of the Indian Penal Code.
Learned counsel appearing for the petitioner no.2 submits that the allegation against him is of abusing the
Patna High Court CR. MISC. No.29192 of 2020(3) dt.06-01-2021 2/2 informant and his family and there is no allegation of assault against petitioner no.2. He has got no criminal antecedent. Considering the facts of the case, in the event of arrest/surrender within eight weeks, let the petitioner no.2, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Kajra Police Station Case No. 27 of 2020 from the Court of Judicial Magistrate 1st class, Lakhisarai, subject to the conditions laid down under sections 438(2) of the Code of Criminal Procedure.
