JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-09-2022 Though, the present writ petition was filed for staying the operation of notice no.F.No.:PTZO/03/2013/1538 dated 17.06.2021, pertaining to taking over the possession of the properties of the petitioner in pursuance to the order dated 04.06.2021, passed in the original complaint no. 1275 of 2020 (arising out of PAO No. 04 of 2020), by the learned Adjudicating Authority, on the ground that the Appellate Tribunal, required to be constituted under Section 25 of the Prevention of Money Laundering Act, 2002, is not functional and the appeal filed by the petitioner before the Appellate Tribunal is not likely to be heard in the near future, however, the Learned Additional

Patna High Court CWJC No.12154 of 2021(3) dt.21-09-2022 2/2 Solicitor General of Union of India Dr. Krishnanandan Singh has handed over to this Court, two notifications dated 11.07.2022 and 08.09.2022, whereby and where under not only 4 members but a Chairman has also been appointed to the said Appellate Tribunal, hence, it is submitted by the learned Additional Solicitor General of India that the Appeal of the petitioner would definitely be taken up very soon. The learned counsel for the petitioner thus submits that the learned Appellate Tribunal be directed to hear the Appeal of the petitioner forthwith.
