2. The petitioner apprehends his arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, 11.04 litres of illicit foreign liquor has been recovered from the house of the petitioner.

4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case. Nothing has been recovered from the conscious possession of the petitioner.

5. Learned APP for the State submits that the recovery has been made from the house of the petitioner, as
