The petitioner apprehends his arrest in connection with Musrigharari P.S. Case No. 152/2018 registered for the offence punishable under Sections 272/273 of the Indian Penal Code and Section 30(a)/47 of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that he had lent his pick-up van to his friend Ranjan Kumar for his personal work and it is not known as to how and under what circumstances the alleged recoveries were purported to have been made from the van which is admittedly in his name. Learned counsel for the petitioner further submits that the entire allegations have been manufactured since the petitioner had contested the 2016 Panchayat Election and enemical forces who were out to tarnish his image have got the present case instituted making false and

Patna High Court CR. MISC. No.27905 of 2019(3) dt.19-07-2019 2/2 frivolous allegations. Learned counsel for the petitioner also submits that the petitioner has no criminal antecedent. Considering the aforementioned facts and circumstances, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IIIcum-Special Judge, Excise, Samastipur, in connection with Musrigharari P.S. Case No. 152/2018, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Anjana Mishra, J) Saif/- U T
