JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner and learned counsel representing the State.

Petitioner apprehends his arrest in connection with Kursakanta P.S. Case No.154 of 2016 registered for the offences punishable under Sections 406, 409, 420/34 of the Indian Penal Code.

Allegedly, the petitioner being the headmaster of Primary School Dumaria Muslim Tola misappropriated government funds which was allotted for providing scholarship to SC/ST and OBC students amounting to Rs. 3,40,200/-.

Submission is of false implication and that the petitioner has got no criminal antecedent, due to mistake of fact the present case has been instituted, the alleged amount of Rs. 3,40,200/- has already been deposited by the petitioner before the competent authority vide annexure-2 to the present application.

Patna High Court Cr.Misc. No.54145 of 2016 (2) dt.21-12-2016 Learned APP submits that the petitioner is named in the first information report.

In the facts and circumstances stated above, the petitioner above named, in case of his arrest or surrender within six weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Kumar Amit Mannu, J. M. Ist Class, Araria in connection with Kursakanta P.S. Case No. 154 of 2016, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) avin/- U T
