This application for anticipatory bail, arises out of Bibhutipur Police Station Case No. 346 of 2018, disclosing
Patna High Court CR. MISC. No.30169 of 2019(2) dt.07-05-2019 2/3 offences punishable under Sections 147, 323, 341, 353 and 504 of the Indian Penal Code.
There is allegation against the petitioners named in the First Information Report and several others of having blocked the road, protesting against the administration in the wake of death of a young boy, in a road accident. There are 20 persons named in the First Information Report and allegedly more than 150 persons had participated in commission of offence.
Considering the submission made on behalf of the petitioners that the allegation is of general and omnibus, this application is allowed.
Let the petitioners, above-named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Rosera (Samastipur) in connection with Bibhutipur Police Station Case No. 346 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case
