JUSTICE RAKESH KUMAR ORAL ORDER 09-11-2017 Heard Sri Krishna Prasad Singh, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner, apprehending his arrest in Rosera P.S. Case No. 178 of 2017 registered for the offence under section 30, 38 of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender. It was submitted by learned counsel for the petitioner that save and except confessional statement of the co- accused, there is no other material to connect the petitioner in the present case whereas, petitioner is having clean antecedent , which fact has been stated in paragraph no. 3 of the petition. Considering the fact that petitioner's name has come only on confessional statement of the co- accused as well as clean

Case No. 178 of 2017 subject to the conditions as contemplated under section 438 (2) of the Code of Criminal Procedure, 1973.
