Learned counsel for the petitioner is expected to honor his undertaking given in the instant case for depositing the requisite court fee and to remove the defects as pointed out by office when called upon.
Petitioner apprehends arrest in connection with Singhwara PS Case No 83 of 2016, instituted for the offence under Section(s) 409 and 420 of the Indian Penal Code. Learned senior counsel submits that the only difference between the rejection of the anticipatory bail under order dated 17.09.2016 passed in Cr. Misc. No. 38233 of 2016 and the instant proceedings is that now the petitioner is willing to deposit amount of loss alleged, without prejudice to his defence at the trial.
In view of such submissions, this Court only reiterates the observation of the order dated 17.09.2016 passed by this Court in Cr. Misc. No. 38233 of 2016:
Patna High Court CR. MISC. No.28692 of 2020(5) dt.29-01-2021 2/2 "The petition stands disposed of with observation that if within a period of six weeks from today the petitioner appears before the court below and makes a prayer for regular bail, the learned court below without being prejudiced with this order may examine the same and pass appropriate order in accordance with law preferably on the same day." The anticipatory bail application stands disposed off.
