2. The petitioners have prayed for bail in a case registered for the offence punishable under Sections 140(2) of B.N.S.
3. The case of the prosecution, in short, is that the son of the informant disclosed the informant that he has been kidnapped by one Amar Das and that Rs. 1,60,000/-was demanded as ransom.
4. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. They have been falsely implicated in this

Learned counsel for the petitioners has submitted that on the same day the victim was recovered and he has given his statement under Section 180 of the B.N.S.S. Learned trial Court has recorded that the statement of the victim was recorded under Sections 180 and 183 of the B.N.S.S. wherein the victim states that petitioners along with two other accused persons kidnapped him. It has further been submitted that save and except the confessional statement of petitioner no.1 in which the name of petitioner no.2 has also surfaced, there is nothing against the petitioners. It has further been submitted that from perusal of the F.I.R. it transpires that the main thrust of allegation is against one Amar Das. It has also been submitted that due to intervention of well-wishers, parties have compromised the case. Petitioner no. 1 is having criminal antecedent of two cases and in both the cases he is on bail whereas petitioner no. 2 is having no criminal antecedent. They are languishing in judicial custody since 18.01.2026.
5. Learned APP for the State has vehemently opposed the prayer for bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail
Patna High Court CR. MISC. No.28936 of 2026(2) dt.05-05-2026 3/3 bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 1st, Saharsa in connection with Bangaon P.S. Case No.04 of 2026.
