Ms. Asha Devi, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 21-03-2022 Heard leaned counsel for the petitioners and learned APP for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 436, 427, 120(B) and 506 of the Indian Penal Code.

It is a case of setting fire in the shop of the informant due to which informant causing loss of property worth Rs.4,00,000/- and cash of Rs.15,757/- and when the informant and her daughter raised alarm, the accused persons forcibly pressed her mouth and threatened to shoot.

It is submitted by learned counsel for the petitioners

Patna High Court CR. MISC. No.38544 of 2021(2) dt.21-03-2022 2/2 that the petitioners have falsely been implicated in this case. He further submits that both parties are Pattidars and one Kamakhya Narayan Singh sold the share of land to the petitioners without any family partition and to avoid the legal action, he implicated the petitioners in the false case. He further submits that during course of investigation, witnesses have stated that they have not seen any one putting the shop of the informant on fire. Petitioners have got clean antecedent. Learned APP appearing for the State has opposed the prayer for anticipatory bail.

In the facts and circumstances of the case, let the petitioners, above named in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 35 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
