Petitioner seeks regular bail in a case registered for the offence punishable under Section 302, 201 of the Indian Penal Code.

As per the prosecution case, on recovery of an unidentified dead body FIR was registered against unknown. Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner has come in this case during the course of investigation in the confessional statement of co-accused, Vikash Kumar, and even as per confessional statement of co-accused petitioner was only alleged to be conspirator and it was co-accused, Haider, who

Patna High Court CR. MISC. No.38918 of 2021(2) dt.17-01-2022 2/2 caused death of the deceased. Petitioner claims clean antecedent and is in custody since 25.02.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.
