2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 467, 468, 471, 420 and 120(B) of the Indian Penal Code.
3. The petitioner is alleged to have obtained appointment, as Panchayat Teacher, on the basis of forged and fabricated document(s).
4. It is submitted on behalf of petitioner that petitioner was appointed, as Panchayat Teacher, after investigation of all his educational certificates by the concerned department, but later on, same have been declared as forged and fabricated without proper verification or giving any notice to the petitioner. Moreover, petitioner has already been resigned from service
Patna High Court CR. MISC. No.29099 of 2023(4) dt.01-08-2023 2/2 vide resignation application dated 20.04.2023 (photocopy annexed as Annexure- 2 to the petition).
5. Learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail.
6. Considering the fact that petitioner has already resigned from the service, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnea in connection with Rupauli (Mohanpur) P. S. Case No. 383 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
