This application, for grant of anticipatory bail, arises out of Turkaulia P.S. Case No. 253 of 2016, disclosing offences under Sections 384 and 34 of the Indian Penal Code. The allegation against the petitioners is of threatening the informant and his family members and asking for ransom. It is also alleged against them that they are attempting to acquire the possession over the piece of land, which belongs to the informant. Learned counsel for the petitioners, has submitted that the petitioners have been maliciously implicated for oblique reasons and earlier also a false First Information Report had been

Patna High Court Cr.Misc. No.42958 of 2016 (2) dt.25-10-2016 2/2 filed, in which the informant in the present case is shown as witness.

Considering the submission, as above, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran, in connection with Turkaulia P.S. Case No. 253 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bond shall be liable to be cancelled.
