The petitioner seeks bail in Sadar Hajipur P.S. Case No. 43 of 2019, instituted for the offence under Section(s) 392 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the written report. It is mentioned in the seizure list that two Mobile phones have been recovered from possession of the petitioner, but no Test Identification Parade of those articles has ever been held. The informant has also not given any description of the aforesaid Mobile to the police. Petitioner is in custody since 27.1.2019 having clean antecedent.

Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Sadar Hajipur P.S. CaseNo. 43 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner.
