JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 28-06-2018 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Kathaiya P.S. Case No.32 of 2018 registered under Sections 147, 447, 341, 323, 307, 379, 427, 504, 385 and 354C of the Indian Penal Code.

Considering the submission made by the learned counsel for the petitioners that there is case and counter case and though there is allegation that all the accused persons participated in the

No.35242 of 2018 (2) dt.28-06-2018 2/2 commission of the assault upon mother of the informant, on examination the doctor could found only one simple superficial lacerated wound measuring 1⁄2" x 1⁄4" on scalp, in the event of arrest or surrender in the court below within six weeks from today, the petitioners are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Addition Chief Judicial Magistrate-II (West), Muzaffarpur in connection with Kathaiya P.S. Case No.32 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J) Md.S./- U T
