JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-01-2021 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor representing the State. The petitioner apprehends arrest in a case registered for the offence punishable under section 323/ 427 and other ancillary sections of the Indian Penal Code.

As per FIR, 12 named accused persons including the petitioner and other 100 to 150 unknown persons blocked the road near Keshav More in protest of a road accident death. It is further alleged that they obstructed the police in discharge of official duty of maintaining law and order.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation and there is no allegation of any overt act against him. Petitioner has got no criminal antecedent.

In the event of arrest/surrender, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in Barun Police Station Case No. 257 of 2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
