The petitioner apprehends his arrest in connection with Rajeev Nagar P.S. Case No. 87/2019 registered for the offences punishable under Sections 353/504/420/467/468/ 471/120(B) of the Indian Penal Code and Section 3 of the Damage to Public Property Act.

As per the prosecution case, it is alleged that one Manvendra Kumar Singh, Assistant Area Officer, Bihar State Co-operative Federation, Patna, sent a letter to S.H.O. Rajeev Nagar P.S. alleging therein that Pradeep Mahto, Ex-M.L.A. and Mala Rai have illegally and fraudulently captured the land of the Federation situated in Chandra Vihar Colony (commonly

It is further alleged that some local influential people, including these petitioners, are indulged in the activity of usurping government land by playing fraud. It is submitted on behalf of the petitioner that from perusal of the FIR itself, it is apparent that the specific allegation of capturing government land is against Pradeep Mahto, Ex-M.L.A. and Mala Rai and no overt act has been attributed against this petitioner. It is further alleged that the petitioner has been named only because he has filed Arbitration Case No. 122 of 2019 against the Chairman with regard to the election held in Bihar State Co-operative Federation which is still pending.

Considering the aforementioned facts and circumstances and the nature of allegations as alleged, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge-III,-cum-Additional Chief Judicial Magistrate-III, Patna and its successor court in connection with Rajeev Nagar P.S.
