The petitioners seek pre-arrest bail in connection with Complaint Case No. 999 of 2016 in which cognizance has been taken under Sections 302 and 201 read with 34 of the Indian Penal Code.
Regard being had to the admitted position that
Patna High Court Cr.Misc. No.50881 of 2017 (2) dt.10-11-2017 though the petitioners were named in the first information report, on completion of investigation, the police submitted final report against them and only father of the deceased child was charge-sheeted and the petitioners have been summoned after acceptance of the police report on the basis of a protest petition filed by the informant, which was registered as a separate complaint, they are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Saharsa in connection with Complaint Case No. 999 of 2016 subject to the conditions as laid down under Section 438(2) Cr. P.C. in the event of arrest or surrender in the court below within six weeks from today.
