JUSTICE SANJAY PRIYA ORAL ORDER 17-11-2017 Heard learned counsel for the petitioners and learned A.P.P. for the State.

Petitioners apprehend their arrest in Kuchaikot P.S. Case No.184 of 2017 for the offence under Sections 147, 149, 308, 323, 324, 325, 379, 504, 506 of I.P.C. As per written report there is allegation against the petitioners that while the informant was going to his field, these petitioners along with other co-accused assaulted the informant with rod causing injury. The coaccused Vinay Singh snatched golden chain of the informant on the order of petitioner no.3. The co-accused Ashok Singh assaulted informant with Tangi causing

Patna High Court Cr.Misc. No.53272 of 2017 (3) dt.17-11-2017 2/3 injury on his head.

Counsel for the petitioners has submitted that there is specific allegation against the Ashok Singh of assaulting the informant with tangi causing injury on his head. The injury report of the informant is annexed as Annexure-4 wherein the doctor has found injury no.4 simple in nature and opinion of injury no.1 was kept reserved.

In the facts and circumstances of the case, prayer of the petitioners for grant of anticipatory bail is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of A.C.J.M.VII, Gopalganj, Kuchaikot P.S.Case No.184/17 subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with further conditions:

(1) bailors should be local having sufficient immovable property within the jurisdiction of the court concerned, (2) petitioners shall cooperate in the trial and shall be present on each and every date fixed by the court and absence on two consecutive dates without proper and reasonable
