09-11-2017 Heard Sri Nil Kamal, learned counsel for the petitioners and Sri Pramod Kumar Pandey, learned Addl. Public Prosecutor. Two petitioners, apprehending their arrest in Buxar Town P.S. Case No. 528 of 2017 registered for offence under Sections 272, 273, 34 of the Indian Penal Code and Sections 30(A), 41(i) of Bihar Prohibition and Excise Act, 2016, have prayed for grant of bail in the event of their arrest or surrender. It was submitted by learned counsel for the petitioners that save and except confessional statement of the co-accused, there is no other material to connect the petitioners in the present case, whereas, the petitioners are having clean antecedent, which fact has been stated in paragraph - 3 of the

Patna High Court Cr.Misc. No.52340 of 2017(2) dt.09-11-2017 2/2 petition.

Considering the fact that petitioners' name has come in confessional statement of the co-accused as well as clean antecedent, in the event of arrest or surrender within a period of six weeks from today, let both petitioners namely Tuntun Ojha @ Abhishekh Ojha and Lala Rai @ Dhramraj Kunwar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. District & Sessions Judge 2nd -cumSpecial Judge, Excise Act, Buxar in connection with Buxar Town P.S. Case No. 528 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
