JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 27-04-2017 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the State.
In this application for anticipatory bail the petitioners apprehend their arrest in connection with Chakia P.S. Case No. 237 of 2016 for the offences punishable under sections 341, 323, 379, 307 and 34 of the I.P.C.
At the very out set it is submitted on behalf of the petitioners and the opposite party no.2 that the matter has been compromised, there is case and counter case and both the cases have been compromised, the informant Sahjadi Khatoon is the
Patna High Court Cr.Misc. No.54639 of 2016 (5) dt.27-04-2017 2/2 daughter-in-law of petitioner nos. 2 and 3 and the petitioner no.1 is the brother-in-law of the opposite party no.2, earlier there was a case under section 498 A of the I.P.C. wherein bail was granted and then this case has been lodged, but now good sense has been prevailed between the parties and the matter has been compromised.
In view of the compromise arrived at between the parties and further considering that this is a family dispute, the petitioners, in case of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of. A.C.J.M-13, Motihari, East Champaran in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) Abhay/- U T
