====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 30-04-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Industrial Area P.S. Case No. 195 of 2018, instituted for the offence under Section(s) 147, 148, 149, 341, 342, 353, 323, 307, 332, 504, 506, 224 and 225 of the Indian Penal Code.

It is alleged in the written report that informant along with other police personnel for arresting petitioner in industrial Area P.S. Case No. 94 of 2018, raided his house. The wife of petitioner namely, Kiran Devi called other people as named in the First Information Report. They came and started abusing the police party and forcibly set free this petitioner from custody of the police. It is further alleged that all named

Patna High Court CR. MISC. No.28008 of 2019(2) dt.30-04-2019 2/2 accused assaulted the police party with lathi. The police party anyhow caught petitioner and brought him towards police jeep. It is further alleged that petitioner pulled the muffler of the informant and managed to run away. Other accused persons tried to snatch rifle from Police party.

Counsel for the petitioner submits that petitioner has voluntarily surrendered on 13.2.2019 and since then he is in custody.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Industrial Area P.S. Case No. 195 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
