2. The petitioner has prayed for anticipatory bail in a case instituted for the offence under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. The allegation against the petitioner along with others is of killing the son of the informant by gun-shot which hit his palm and abdomen and in the way to hospital, he died.

4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case due to dirty village politics. He has committed no offence. There is general and omnibus allegation against the petitioner rather the specific allegation against co-accused Harischandra Rai, who shot fired upon the deceased, due to which he died. There is no

Similarly situated other accused person has already been enlarged on bail by another coordinate Bench of this Court vide order dated 17.02.2024 passed in Cr. Misc. No. 7962 of 2024. Petitioner has got no criminal antecedent as stated in para-3 of the bail petition.

5. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Kalyanpur P.S. Case No. 245 of 2023., he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur subject to the conditions as laid down under section 438(2) of the Cr.P.C.
