13-12-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Kurtha (Manikpur O.P) P.S. Case No. 151 of 2020, registered for the offence under Section 307 & other allied sections of the Indian Penal Code. As per the F.I.R., this petitioner assaulted one Upendra Kumar Singh with iron rod, as a result of which he sustained head injury, which as per injury report, appears to be grievous in nature.

There is case and counter case and both sides sustained injury. Admittedly, there is land dispute between the parties. Both parties are agnates. It is submitted that in fact, there was some hot exchange of words between brother of informant and son of petitioner over plucking of guavas from

Patna High Court CR. MISC. No.38805 of 2021(2) dt.13-12-2021 2/2 guava tree and thereafter, alleged occurrence took place between them. Petitioner has got clean antecedent and he is in custody since 18.01.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances as well as period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Arwal in connection with Kurtha (Manikpur O.P) P.S. Case No. 151 of 2020.
