This application has been filed by the petitioner for modification in the order dated 23.08.2017 passed in Criminal Misc. No. 15930 of 2017 by this court.

Learned counsel for the petitioner submits that vide order dated 23.08.2017 passed in Criminal Misc. No. 15930 of 2017, the petitioner was granted provisional anticipatory bail, in the event of arrest or surrender before the court below, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Purnea, in connection with K. Nagar (Maranga) P.s. Case No. 286 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C. with condition that if the petitioner submits the receipt regarding depositing of cash of Rs. 11,12,050/- in the Oriental Bank of Commerce, Purnia Branch

Patna High Court Cr.Misc. No.30378 of 2018(2) dt.16-05-2018 2/2 within two months, the provisional bail of the petitioner shall be confirmed by the court below. If the petitioner fails to submit the receipt showing the deposit of Rs.11,12,050/-, the court below will cancel his bail bond, but the petitioner could not deposit the aforesaid amount within the stipulated period due to personal difficulties and now he deposited the aforesaid amount, which would appear from annexure 3 of the application, showing the deposit of Rs.11,12,050/-. In that view of the matter, learned counsel for the petitioner prays for extension of time for submitting the receipt with regard to deposit of the aforesaid amount in the court below.

Considering the submission of the learned counsel for the petitioner, the period for submitting the receipt showing the deposit of aforesaid amount by the petitioner in connection with the aforesaid case in the court below is further extended for six weeks from today and this application is, accordingly, allowed with the aforesaid modification in the order dated 23.08.2017 passed in Criminal Misc. No. 15930 of 2017.
