This application for regular bail in Trial No. 4338 of 2021, arises out of Excise Case No. 55 of 2020, disclosing offence punishable under Section 30(a) of Bihar Prohibiton and Excise (Amendment) Act, 2018.

The petitioner is in custody since 16.02.2020. His prayer for regular bail was earlier rejected by this Court by an order dated 13.10.2020, passed in Cr. Misc. No. 24189 of 2020. Allegedly, from the possession of the petitioner, 131.25 litres of Indian made foreign liquor was recovered by the police.

Patna High Court CR. MISC. No.38214 of 2021(2) dt.04-08-2021 2/2 has submitted that there is no substantial progress at the trial. Be that as it may, considering the fact that the petitioner is in custody since 16.02.2020, this application is allowed. Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned A.D.J.-II cum Special Judge, Excise, Gopalganj, in Trial No. 4338 of 2021, arising out of Excise Case No. 55 of 2020.
