KUMAR ORAL ORDER 24-05-2018 Heard learned counsel for the petitioner and the State. Petitioner seeks pre-arrest bail in Kargahar P.S. Case No.127 of 2017 instituted for the offences under Sections 307, 379,323, 341, 147, 149 of the I.P.C.

The informant has alleged in his written complaint that when he was sitting in his shop at about 6 O' clock in the morning, the petitioner and other co-accused came there and abused and assaulted him. Allegation against the petitioner is that he was armed with rifle and assaulted the informant resulting in fracture in his left arm.

Learned counsel for the petitioner submits that in the order of the learned District and Sessions Judge the injury sustained by the informant has been mentioned in paragraph 5 of

Patna High Court Cr.Misc. No.32021 of 2018 (2) dt.24-05-2018 2/2 his order and no fracture or any type of injury has been found on the left arm of the informant. It has further been submitted that injury as reported in the impugned order are of simple in nature and no grevious injury has been found on the informant. All the injuries are lacerated and bruise injury. It has further been submitted that apart from the present case only one criminal antecedent is against him, i.e. Kargahar P.S. Case No.11/2006 Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of A.C.J.M., Rohtas, Sasaram, in Kargahar P.S. Case No.127 of 2017 subject to the conditions as laid down under Section 438(2) of Cr.P.C. (S. Kumar, J) AnilKrSinha/- U
