1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Ganga Bridge P.S. Case no. 221 of 2023 (B. P. no.395 of 2024) registered under sections 302, 201 and 34 of the Indian Penal Code.

3. As per the prosecution case, the informant states that she heard some sound coming from the side of her house and going near it she saw her son hanging. The informant further states that the seven named accused including the petitioner herein were seen running away. As such, it is stated that the accused persons murdered her son by hanging him.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case because of land dispute between the parties, who happen to be patidars. The allegations as levelled against the petitioner in the F.I.R were

Patna High Court CR. MISC. No.31395 of 2024(3) dt.26-07-2024 2/2 not found correct and as such charge-sheet was submitted under section 306 of the IPC. The petitioner is in custody since 8.11.2023 and has no criminal antecedent.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, the material that has transpired in course of investigation, charge-sheet having been submitted under section 306 of the I.P.C., the petitioner having remained in custody for 8 months since 8.11.2023 and investigation in the case having concluded, the petitioner is directed to be enlarged on bail in connection with Ganga Bridge P.S. Case no. 221 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur.
