JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-06-2018 Petitioners apprehend their arrest in connection with Sitamrhi P.S.Case No. 1055 of 2017 registered for the offences punishable under Sections 341, 323, 307, 379, 504 and 506/34 of the Indian Penal Code.

Allegation against the petitioner No.1 is of assault by rod on the head of the informant and against petitioner No.3 there is allegation that he assaulted son of informant by rod and there is also allegation of assault against other petitioners. Submission of learned counsel for the petitioners is that only two injuries were found on the person of informant and his son and there is general and omnibus allegation against petitioners Nos. 2, 4 and 5.

Heard learned APP and learned counsel for the informant. They have opposed the prayer for anticipatory bail.

No.31195 of 2018 (3) dt.27-06-2018 2/2 Having heard both sides and in the facts and circumstances, let the petitioners Nos. 2, 4 and 5, named above, in the event of their arrest or surrender be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in connection with Sitamarhi P.S.Case No. 1055 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions are that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned. So far petitioners Nos. 1 and 3, named above, are concerned, they are directed to surrender within a period of six weeks from the receipt of this order and pray for regular bail, which shall be considered on its own merit.

With the above observation, this application is disposed of.
