====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-08-2024 Heard learned counsel for the petitioner and the State.

2. The petitioner seeks regular bail in a case registered for the offence punishable under sections 341, 323, 307, 504/34 of the Indian Penal Code.

3. As per the prosecution case, while the demarcation of land was going on, accused persons started fighting with the prosecution side. In the meantime, co-accused Ram Narayan Yadav and Debu Yadav set on fire Bhuskar of informant. Thereafter, petitioner and Rajesh Yadav made firing and fled away from the spot.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case as he is relative of co-accused Debu Yadav. Though there is allegation of firing, but nobody sustained fire arms injury. Petitioner claims clean antecedent. Charge sheet has already been filed. Petitioner is in custody since 11.2.2024.

5. Learned counsel for the State opposes the prayer for bail.

6. Considering the aforesaid facts of the case, prayer for regular bail of the petitioner is allowed. Let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Biraul, Darbhanga in Kusheshwarasthan Police Station Case No. 86 of 2022.
