20-01-2021 Heard learned counsel for the petitioner, earned A.P.P. for the State as well as learned counsel for Vigilance Investigation Bureau.

The petitioner apprehends his arrest in Sohail P.S. Case No. 02 of 2020 registered for the offence under Sections 420, 467, 468, 471 and 120(B) of the Indian Penal Code. As per the prosecution case, petitioner obtained his appointment on the basis of forged and fabricated certificate. It is submitted on behalf of petitioner that without any query or notice to the petitioner, the certificate, submitted by the petitioner, has been proved forged and fabricated and thereafter, the petitioner has been terminated from the service. It is stated in paragraph -3 of the petition that petitioner has no criminal

However, Sri Rana Vikram Singh, learned counsel for the Vigilance Investigation Bureau opposed the bail application and submitted that allegation against the petitioner is very serious. The petitioner has got his appointment on the basis of forged and fabricated certificate.

Considering the fact that appointment of the petitioner has already been cancelled and petitioner has got clean antecedent, the anticipatory bail application of petitioner is allowed. In the event of his arrest or surrender within a period of eight weeks from the date of receipt/production of copy of this order, let the above-named petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sherghati (Gaya), in connection with Sohail P.S. Case No. 02 of 2020, subject to condition as laid down under Section 438(2) of the Cr.P.C.
