2. This application has been filed for restoring the Second Appeal No. 301 of 2012 which was dismissed for default on 25.04.2023 for non-compliance of peremptory order dated 11.04.2023 passed by this Court.

3. It is submitted that there is no deliberate latches either on the part of the appellants or the counsel for the appellants and the same has occurred due to inadvertence which was beyond the control of the appellants or counsel for the appellants.

4. For the reasons stated above, this M.J.C. application filed for restoration of Second Appeal No. 301 of
