The petitioner apprehends his arrest in Athmalgola P.S. case No. 104 of 2016 for the offences punishable under Section 25 (1-B) (a) and 26 of the Arms Act.
The prayer of petitioner for anticipatory bail was earlier rejected by this court vide order dated 13.04.2017 passed in Cr. Misc. No. 15557 of 2017.
The learned counsel for the petitioner submits that only two rifles were recovered from the house of the petitioner and no ammunition was recovered but considering the fact that rifles without license were recovered from the house of petitioner, prayer of petitioner for anticipatory bail was earlier rejected vide order dated 13.04.2017.
I do not find any fresh ground to reconsider the
Patna High Court Cr.Misc. No.52549 of 2017 (2) dt.08-11-2017 2/2 prayer of petitioner for anticipatory bail. Accordingly, once again the same is rejected.
If the petitioner surrenders in the court below, i.e., learned Sub divisional Judicial Magistrate, Barh, Patna in Athmalgola P.S. case No. 104 of 2016, the learned court below shall consider the prayer for regular bail of the petitioner on its own merit without being prejudiced from the order of this court.
