ANJANA MISHRA ORAL ORDER 29-08-2016 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. Learned counsel for the informant is also present.
The petitioners are apprehending their arrest in connection with Raghopur P.S. Case No.34 of 2016 for allegedly having committed the offences under Section 302/34 of the Indian Penal Code, which is pending in the court of the learned Chief Judicial Magistrate, Vaishali at Hajipur. Case diary in the present case was called for, which has since been received.
After hearing learned counsel for the petitioners and the learned counsel for the informant and on perusal of the case
Patna High Court Cr.Misc. No.28936 of 2016 (4) dt.29-08-2016 2/2 diary it appears that the petitioners along with Arvind Singh, who is the main assailant, had conspired to kill the deceased. As such, the deceased was called by these petitioners to the house of the present petitioners where the said Arvind Singh fired resulting in his death. There is further cogent material in the case diary to support the case of the prosecution. In view of such facts and circumstances, I am not inclined to grant anticipatory bail to the petitioners. It is, accordingly, rejected.
