JUSTICE ARUN KUMAR ORAL ORDER 26-07-2017 Learned counsel for the petitioners submits that the petitioners have challenged the cognizance order dated 16.7.2013 passed by Judicial Magistrate Ist Class, Patna in Complaint Case No.573(C) of 2013 whereby the cognizance has been taken under Sections 323, 504 and 342 of the Indian Penal Code. This complaint case was filed by Rahul Sinha, sonin-law of petitioner no.1 and daughter of petitioner no.1 Sonalika had filed Complaint Case No.583 of 2012 against him under Section 498A of I.P.C. and Section 4 of Dowry prohibition Act

Patna High Court Cr.Misc. No.6654 of 2015 (8) dt.26-07-2017 2/2 but now in the said case today at sl.nos.9 and 10 on the basis of compromise has been disposed of and this matter was also fixed for hearing along with that applications. Since the dispute between husband and wife have already been settled mutually and both agree to withdraw all cases, so in this view of the matter, the entire criminal proceeding including the cognizance order dated 16.7.2013 in Complaint Case No.573(C) of 2013 is hereby set aside.

The petition stands allowed.
