JUSTICE SUDHIR SINGH ORAL ORDER 24-11-2016 Heard learned counsels for the petitioners, informant and learned counsel for the State.

The petitioners are apprehending their arrest in connection with Nawada Town(Nagar) P.S. Case No. 342 of 2016 for the offences instituted under Sections 304(B) of the IPC. The accusation is of killing the daughter of the informant by the accused persons due to non-fulfilment of dowry demand. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioners. The petitioners are the father-in-law and the mother-in-law of the deceased. They are separate in mess and property from the husband of the deceased. The witnesses in paragraph nos. 5, 6 and

Patna High Court Cr.Misc. No.38548 of 2016 (4) dt.24-11-2016 2/2 7 of the case diary have sated that the deceased herself had committed suicide. It is, at best, a case under Section 306 of the IPC.

On behalf of the learned counsels for the State and the informant, it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of six weeks from today in connection with Nawada Town (Nagar) P.S. Case No. 342/2016 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nawada, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
