This application for anticipatory bail arises out of Koilwar P.S. Case No. 382 of 2020 registered for the offence punishable under Sections 384, 385 and 379/34 of the Indian Penal Code, Mines Minerals (Development & Regulation) Act, 1957, under Sections 11, 56(1) of the Bihar Minerals Concession Prevention of Illegal Mining Transportation & Storage Rules, 2019 and under Section 15 of the Environment Protection Act, 1986.

Learned counsel for the petitioners seeks

Patna High Court CR. MISC. No.38337 of 2021(2) dt.18-05-2022 2/2 permission to withdraw this bail application on behalf of petitioner no.2, above named.

Accordingly, this bail application is dismissed as withdrawn as against petitioner no.2, above named. So far as the bail of petitioner no.1 is concerned, the same is allowed considering the fact that he is 76 years old Let the petitioner no.2, above named, in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, Ara, in connection with Koilwar P.S. Case No. 382 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
