The petitioner seeks pre-arrest bail in connection with Rampur Chauram P.S. Case No.43 of 2014 registered under Sections 436 and 120B/34 of the Indian Penal Code (for short 'the I.P.C.').

Regard being had to the submissions made by the learned counsel for the petitioner that on completion of investigation, the investigating officer submitted charge-sheet under Section 435 of the I.P.C. but differing with the police report the learned Magistrate took cognizance of the offence under Section 436 of the I.P.C., in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed
