JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-06-2018 Petitioner apprehends his arrest in connection with Sasaram (Town) P.S.Case No. 244 of 2018 registered for the offences punishable under Sections 307, 34 of the Indian Penal Code and later on 302 IPC was added and Section 27 of the Arms Act.

Allegation against the petitioner is that he along with other accused persons came on a motorcycle and fired at the deceased, causing his death.

Submission of learned counsel for the petitioner is that there is no eye-witness to the occurrence and there is no allegation of firing against the petitioner.

Heard learned APP also, who has opposed the prayer for anticipatory bail of the petitioner.

Patna High Court Cr.Misc. No.31045 of 2018 (3) dt.27-06-2018 2/2 Having heard both sides and in the facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioner, rather petitioner to surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order.
