2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 302, 34, 341, 447 and 504 of IPC. of the Indian Penal Code.
3. As per the prosecution case, on 09..07.2022, all the F.I.R named accused persons including this petitioner and 10 unknown miscreants armed with deadly weapons abused and assaulted the informant and family members, as a result of which, informant's son Bhavesh Kumar died.
4. It is submitted that allegation of assault is general and omnibus in nature. There is no specific allegation of assault or any overt act has been attributed to this petitioner. Case and counter case. Similarly situated co-accused person has already
Patna High Court CR. MISC. No.29180 of 2023(2) dt.17-07-2023 2/2 been granted bail by this Court vide order dated 24.06.2023 in Cr. Misc. No. 19040 of 2023. The petitioner has no criminal antecedent.
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C,J.M-I Vaishali at Hajipur in connection with Bhagwanpur P.S. case no 168 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
