11-07-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends her arrest in a case registered for the offence under Sections 406, 420, 506, 120B/34 of the Indian Penal Code.
3. As per F.I.R., this petitioner and her father took Rs. 2,50,000/- from the informant for the purpose of her (petitioner) marriage with some other boy, since petitioner was in love with son of informant, but neither petitioner was married with some other boy nor father of petitioner returned aforesaid money to the informant and when informant demanded his money, he was threatened to kill.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. As a matter of fact, the informant had given the aforesaid money to father of petitioner for the purpose of marriage of this petitioner.
Patna High Court CR. MISC. No.31528 of 2024(3) dt.11-07-2024 2/2 Petitioner had not taken any money from informant for doing business. Petitioner is lady and has got clean antecedent.
5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sikarhana at Dhaka, East Champaran in connection with Dhaka P.S. Case No. 71 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
