JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 10-08-2016 The petitioner claims to be the adopted son of late Awadh Singh, who died in harness, while working as Meth in Water Resources Department, Biharsharif at Nalanda. It is the petitioner's claim that late Awadh Singh died unmarried and he being his sole legal heir, the petitioner is entitled to receive the entire death-cum- post retiral dues consequent upon death of said Awadh Singh.

In support of such plea, a judgment passed in T.S (Adoption) Case No. 21 of 2007, dated 21.02.2009, by the learned Additional District Judge, Seikhpura, has been

brought on record.

It seems that the respondents have asked the petitioner to furnish succession certificate to consider his claim for payment of death-cum-post retrial dues in his favour.

Learned counsel for the petitioner seeks permission to withdraw this application with a liberty to file required succession certificate for the purpose of pursuing his claim for the said death-cum-post retiral dues.

This application is dismissed as withdrawn with the liberty aforesaid.
