JUSTICE ARUN KUMAR ORAL ORDER 18-10-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with Muffasil P.S. Case No.357 of 2017 registered under Sections 302/34 of the Indian Penal Code as well as Section 27 of the Arms Act.

Learned counsel for the petitioner submits that merely he being a friend of the nephew of the deceased and the nephew is also one of the accused in this case, so he has falsely been implicated.

The learned APP submits that the impugned order itself shows that the statement of the deceased was video recorded by the investigating agency in which he has disclosed the name of the petitioner as one of the assailants.

Having considered the aforesaid facts and

Patna High Court Cr.Misc. No.50046 of 2017 (2) dt.18-10-2017 2 /2 circumstances and the nature of offence, prayer of anticipatory bail of the petitioner is rejected in connection with Muffasil P.S. Case No.357 of 2017, pending in the court of learned A.C.J.M.- Vth, Samastipur.
