====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 26-10-2021 Heard learned counsel for the petitioner, the State and the informant.

The petitioner seeks regular bail in Akbarpur Police Station Case No. 365 of 2020 registered for the offences punishable under section 307 and other allied sections of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, petitioner and other accused persons armed with lathi, danda and fire arms went to the house of the aunt of the informant and started assaulting her. In the meantime, petitioner shot fire causing fire arms injury on the chest of the aunt of the informant.

Learned counsel for the petitioner submits that the parties are co-villagers and there is land dispute between them. Petitioner has got clean antecedent as stated in paragraph 3 of

Patna High Court CR. MISC. No.39600 of 2021(3) dt.26-10-2021 2/2 the bail petition. Petitioner is in custody since 12.11.2020. Investigation is complete.

Learned counsel for the State and the informant oppose the prayer for bail and submits that there is specific allegation against the petitioner that he shot fire on the victim causing fire arms injury on her chest.

Considering the rival submissions of the parties, materials available on the record and the nature of accusation against the petitioner, his prayer for bail is refused. (Prabhat Kumar Singh, J) shashi/- U T
